Terms and Conditions:
By accepting a transportation bid from AcmeLogistics you are agreeing to the following:
This agreement is between you the "Shipper", (hereinafter referred to as “Customer”), and AcmeLogistics (“Carrier" or "TSP" (transportation service provider)).
Agreement is activated by the acceptance of the carrier’s bid by the customer.
The Customer shall, in their absence, designate a person to act as their agent at the point of pick up and/or delivery, if for any reason they are unavailable.
AcmeLogistics is authorized to operate and transport Customer’s property/cargo between its pick up location and the destination set forth on the shipping order-bill of lading.
Carrier’s main responsibility is to transport customer’s property/cargo. Loading and unloading is the customer’s responsibility with the supervision of carrier/driver.
AcmeLogistics is not responsible for any type of injury incurred by others while carrying, lifting, pushing, or other means of moving cargo or for any injury incurred while in, on, or around carrier’s trailer, vehicle, or other conveyance item.
Carrier will pick up and deliver Shipper’s cargo as close to the door as safely as possible. If carrier cannot legally or safely arrive to designated pickup or delivery location a mutually agreeable place to load or unload may be necessary. Reasons could be but not limited to low hanging trees, low hanging wires, narrow streets, truck weight or commercial limitations and residential area restrictions.
AcmeLogistics shall provide Customer with an estimated pick up and estimated delivery date. However, delays may occur prior to, and/or during transport due to weather, road conditions, mechanical problems, etc. There are absolutely no guarantees regarding pick-up or delivery times and dates. AcmeLogistics shall not be held responsible for loss or damages occasioned by delays of any kind or for any reason, car rental fees or any accommodation fees. AcmeLogistics shall not be held liable for failure of mechanical or operating parts of your property/cargo.
It is the Customer’s responsibility to prepare property/cargo for transport. All loose parts, fragile accessories, low hanging items, etc. must be removed or secured. Vehicles/cargo must be tendered to carrier in good running condition or notified that vehicle will not run, but will steer, roll, and brake (unless otherwise noted). Cargo should not contain more than a 25% (1/4) tank of fuel and RV's and Travel trailers shall have all storage tanks (Black-Grey-Potable Water) emptied prior to transportation. Any part of the vehicle/cargo that falls off during transport is the Customer’s responsibility including damages caused by said part to any vehicles(s) and/or person involved.
Customer must disarm any alarm system installed in or on the vehicle/cargo or provide proper instructions for this matter. In the event said alarm sounds and there are no keys or instructions to turn it off, carrier may silence alarm by any means.
Luggage and/or personal property must be confined in one suitcase OR bag in trunk only, with no heavy articles, and not to exceed 100 lbs. Luggage and/or personal property must be disclosed to carrier prior to pick up. Sail Me Properties, LLC is not liable for personal items left in vehicle/cargo, or for damage caused to vehicle/cargo from excessive or improper loading of personal items. No personal property shall be transported in customer's vehicle(s) that includes but is not limited to Explosives, Guns, Ammunition, Flammable Products, Narcotics, Negotiable and Legal Papers, Alcoholic Beverages, Jewelry, Furs, Money, Live Pets, Live Plants or any Unlawful Contraband. Customer agrees that Sail Me Properties, LLC may confiscate or dispose of said items with no remuneration. Sail Me Properties, LLC will not be held responsible for delivery of personal property. If Customer wishes to put items in the vehicle/cargo he does so at his own risk.
OVER SIZE / INOPERABLE
If the vehicle/cargo is inoperable or oversize (dual or oversize wheels, extra-large tires, racks, lifted, limo, etc.) which is different than size or condition indicated prior to the acceptance of bid, Customer must inquire as to extra charges. If AcmeLogistics is not advised of inoperable or over-sized/modified vehicles/cargo prior to pick-up, all extra charges must be paid by Customer in cash or money order upon delivery to the carrier/driver.
If you are shipping an inoperable vehicle/cargo, you may be required to help load and unload said vehicle at the discretion of the driver. Should vehicle/cargo(s) become inoperable during transport, an additional charge may be due at time of delivery in addition to any other moneys owed and is the total discretion of driver to charge. It is shipper’s responsibility to make sure vehicle/cargo is in proper working order. Problems, such as but not limited to, a dead battery, bad alternator, loose cables, etc. that makes the vehicle inoperable during transport will increase the transport price as stated in the additional charges.
If vehicle/cargo is oversize and will not fit into/onto the conveyance unit, Customer will be responsible for any additional costs incurred to legally and safely transport vehicle/cargo by Carrier. If vehicle/cargo is oversize and exceeds allotted space and creates a lack of space for other vehicle/cargo, Customer will be responsible for any additional costs incurred to legally and safely transport other vehicle/cargo by Carrier. If vehicle/cargo is not going to be conveyed a cancellation has occurred. Refer to CANCELLATIONS paragraph.
Once the carrier/driver has been assigned to pick up and transport Customer’s property/cargo, AcmeLogistics will notify the Customer via email or telephone (the email address or telephone number provided in your UShip shipping order). If the Customer cancels the order, prior to the assignment of a Carrier, the deposit paid will be refunded (UShip fee's may still apply.) However, if the Customer decides to cancel his order after a truck/driver has been dispatched the deposit will NOT be refunded.
The Customer agrees that AcmeLogistics has the right to reject any order for any reason at any time.
At the time of pick up, Customer and Carrier/driver will carefully inspect the vehicle/cargo for pre-existing damage (exterior only) by making it noted on the Bill of Lading and taking pictures. The Carrier/driver and Customer will both acknowledge the condition of the vehicle and Customer will sign the bill of lading.
At the time of delivery, Customer and Carrier/driver will carefully inspect the vehicle/cargo for transportation damages. The Carrier/driver and Customer will both acknowledge the condition of the vehicle and Customer will sign the bill of lading.
Damage must be noted in the proper place on the Bill of lading and signed by the Customer, regardless of weather or time of day. Signing the bill of lading and inspection report without notation of any damage verifies that Customer has received vehicle/cargo in satisfactory condition, and that AcmeLogistics, Carrier/driver, and their agents are relieved of any further responsibility. All claims must be submitted in writing within 24 hours of delivery.
Carrier/driver accepts responsibility of cargo after all cargo is loaded, and pre-inspection is done and is signed by the Customer. Carrier/driver responsibility will end when the cargo is unloaded, and Customer signs final inspection.
AcmeLogistics will not be responsible for damage caused by acts of God, hail or storm damage, or damage resulting from worn/broken parts of vehicle/item.
AcmeLogistics nor its agents shall be responsible for the following:
• Damage to undercarriage, exhaust system, suspension, wheel bearings, tie downs, brakes, alignment, tuning, system or battery. (No evaluation is made of these components or systems at pickup location) therefore AcmeLogistics or its agents do not accept responsibility for them.
• Damage not detected at pickup location due to poor weather or lighting conditions.
• Damage to car phones or antenna under any condition (suggest that they be removed prior to shipping)
• Loss of or damage to audio or video equipment not installed at the factory. Including antenna that does not
• retract to within 3 inches of the vehicles body.
• Damage or fines incurred because shipper left personal or household items in vehicle.
• Damage caused by fluids or objects flying up from the roadway, or out of the sky.
• Damage to cloth or vinyl convertible or decorative tops.
• Damage to T-tops, boots, bras, caps, or any other type of canvas covering.
• Damage caused by leaking fluids, such as battery acid, motor oil, transmission fluid, brake fluid, power steering fluid, radiator coolant, or fallout resulting from acts of god.
• Damage caused by freezing of cooling system and/or battery.
• Damage caused by failure of factory tie-downs or pull through from tie-down holes.
Customer warrants that customer will pay the transportation price/deposit due to AcmeLogistics for delivered property/cargo, and will not seek to charge back a credit card or stop a check to offset any dispute for damage claims and/or delays etc. It is the Customer‘s responsibility to have any payment due when the Carrier arrives. All payments for Carrier must be in the form of UShip payments or Cash. No exceptions.
For Customers utilizing the uShip Payments program: Customer (Shipper) must provide an original print out from their Uship website account with the generated payment code for the particular shipment directly to the delivering driver.
The Customer agrees that if the payment cannot be made by these methods, the property/cargo will be stored at the Customer‘s expense until Customer pays in full all transport charges. Should the Customer be unable to accept delivery for any reason, the property/cargo will be placed in storage. Any and all storage and delivery charges will be the responsibility of the Customer.
Additional Charges will be charged in addition to the accepted bid if the following circumstances exist and not disclosed before bid was accepted or was created at particular time after accepted bid.
Cargo does not run to be moved, the cargo must at roll on it's own wheels and tires (this includes any winching onto the truck/trailer) $100 per transit
Cargo does not roll $200 per transit
Cargo leaks fluid $100 per transit
Not able to Load/Unload on time $50/hr $50 min
Layover due to customer not being able accommodate pickup or delivery time $250 per night
Cargo has to be Loaded/Unloaded by AcmeLogistics unless stated in agreed bid acceptance that carrier will load - see note*
Cargo has to be moved to higher elevation or lower elevation of ground level $50 per flight
Cancellation before transporter is dispatched 0% of Rate UShip fee's may still apply.
Cancellation after transporter is dispatched 100% of Rate
Repairs to any towed trailer as a result of a mechanical brake-down of said trailer -
:Actual cost of parts paid on delivery by customer (receipt/s provided by carrier to customer) and labor $75 per hour
*NOTE – per motorcycle $30; per ATV/UTV $30, per automobile $30; per 2 pc of avg furniture $75; per 2 box 2’x2’x2’ $30; for uncommon items not fitting above driver will have full authority to charge within reason based on these specific rates as comparable.
This Agreement shall be construed in accordance with the laws of the State of Kentucky.
The parties here agree that all actions or proceedings arising in connection with this agreement shall be tried and litigated exclusively in the State or Federal (if permitted by law and a party elects to file an action in federal court) courts located in Daviees County, in the State of Kentucky.
This choice of venue is intended by the parties to be mandatory and not permissive in nature, and to preclude the possibility of litigation between the parties with respect to, or arising out of, this Agreement in any jurisdiction other than that specified in this section. Each party waives any right it may have to assert the doctrine of forum non convenience or similar doctrine or to object to venue with respect to any proceeding brought in accordance with this section by action of this provision; the parties agree to submit to the personal jurisdiction of the aforementioned court.
This agreement and any shipment here under is subject to all terms and conditions of the carrier's tariff and the uniform straight bill of lading, copies of which are available upon request.
This supersedes all prior written or oral representation of AcmeLogistics and constitutes the entire agreement between Customer and AcmeLogistics and may not be changed except in writing signed by an officer of AcmeLogistics.
